Over the past 30 years, Carlos has assisted numerous landowners in complying with provisions of Arizona’s Groundwater Management Act. Sometimes, these matters were resolved through administrative hearings, or rarely, litigation. As he came to know these landowners, he often was asked to represent them in general business and real estate matters as well.
One such client owned approximately 7,000 acres of agricultural land, but was master-planning it for future development. There, Carlos assisted the client with retaining hydrologists, and then acquiring from the Arizona Department of Water Resources a determination that sufficient water was available to meet the long-term water demands for its proposed development.
Carlos also assisted a landowner in Mohave County, Arizona, in demonstrating to the Arizona Department of Water Resources that sufficient groundwater was available for a master-planned community on about 5,500 acres near Kingman. In addition, he assisted the same landowner with the formation of a private water and sewer company that could provide utility service to this development. The formation of this utility company required an extensive administrative proceeding before the Arizona Corporation Commission.
