Over the years, Carlos has represented numerous private water companies in various regulatory matters. Before the Arizona Corporation Commission, he represented a water company in a rate case that secured a reduced “off-peak” electric rate for pumping groundwater. In a second rate case, he worked to recover charges associated with contracting for Central Arizona Project water.
Carlos also has assisted many water companies with extending their water service infrastructure to new areas, acquiring easements across lands administered by the Arizona State Land Department, purchasing sites for infrastructure and complying with the regulatory requirements of the Arizona Department of Water Resources.
In yet another matter, a water company faced the imposition of a moratorium on future connections because its total water deliveries were approaching the quantity of water that was available for delivery to its customers under an order previously entered by the Arizona Department of Water Resources. Carlos assisted that water company by retaining a hydrologist and then worked with the Department of Water Resources to demonstrate that additional water was available to meet long-term water demands. As a consequence, the Department of Water Resources then amended its order so that the moratorium on future connections was no longer necessary.
In southern Arizona, Carlos worked with a developer who owned a small water company to address compliance issues with both the Arizona Department of Water Resources and the Arizona Corporation Commission. There, his work included demonstrating to the Arizona Department of Water Resources that sufficient water was available for long-term development purposes.
